Terms and Conditions

When using the webshop, the Terms and Conditions of CoverHoesjes.nl are valid. By placing an order through the webshop, you declare that you agree with the content thereof.

Article 1. Definitions
In these General Terms and Conditions (hereinafter referred to as: Terms and Conditions) the following definitions apply:

1.1. Copper
Every natural person or legal person who comes into contact with the webshop about the formation of an Agreement.

1.2. Agreement
Every agreement that is concluded between the webshop and the Buyer, every change thereof or addition thereto, as well as all legal acts in preparation and in implementation of that agreement.

1.3. Products
Merchandising articles related to Bouletta and PLM Case.

1.4. Services
The services to be provided by the webshop, with or without regard to the products, including advice, assembly and service in the broadest sense of the word.

1.5. Orders
Every order from the Buyer to the webshop.
Orders are only accepted by the webshop if they are placed via the webshop.

Article 2. General
2.1. By placing an order through the webshop, the buyer indicates that he agrees with the conditions. The webshop has the right to change its Terms and their contents after the expiry of the term.

2.2. The webshop ensures that the order is executed after receipt of payment to the webshop. The ordered products are delivered to the buyer, whereby the shipping costs are for the account of the seller and the risk of shipping for the webshop.

2.3. The webshop is authorized to make use of third parties in the execution of the order.

2.4. The web shop is entitled to refuse the buyer access to the web shop without stating reasons.

Article 3. Offers / agreements
3.1. All offers from the web shop are without obligation and the web shop explicitly reserves the right to change the prices, in particular when this is necessary on the basis of (legal) regulations.

3.2. An agreement is only concluded after the buyer has provided all information requested by the webshop and the webshop has confirmed the order by means of an e-mail to the e-mail address specified by the buyer. The buyer must report any inaccuracies in the order confirmation immediately after receipt to the webshop, failing which the order confirmation is deemed to accurately reflect the agreement.

3.3. The webshop is entitled to refuse orders with motivation or to attach special conditions to the delivery, unless explicitly stated otherwise. If an order is not accepted, the webshop will inform you of this within ten (10) working days after receiving the order.

Article 4. Prices and payments
4.1. The stated prices for the products and services are in euros and include sales tax (VAT), unless explicitly stated otherwise. The (purchase) price owed by the buyer and additional costs for VAT and shipping costs are clearly stated in the order confirmation and invoice of the webshop.

4.2. All prices on the webshop are subject to printing and typing errors. No liability is accepted for the consequences of printing and typesetting errors.

4.3. Payment of an order is done through: iDEAL, Paypal or prepayment. Further (payment / order) conditions can be imposed on the order. When paying by bank or giro, the date of payment is the date of crediting the giro or bank account of the webshop.

4.4. The webshop reserves the right not to offer one or more of the aforementioned payment options, for a definite or indefinite period of time.

4.5. The buyer is entitled to cancel an order or to dissolve the agreement in accordance with the legal provision regarding distance selling.

Article 5. Delivery / delivery time / delivery
5.1. Orders paid via iDEAL, Paypal and credit card and placed on the webshop before 5 pm on weekdays are sent within 24 hours, if in stock. We are not responsible for delays due to Christmas crowds. Orders paid via bank or post office will be sent as soon as the payment is received by the webshop.

5.2. The delivery time specified by the webshop is only indicative. Exceeding the delivery time does not give the buyer the right to compensation or the right to cancel the order. If the delivery time is exceeded, the buyer will be informed by e-mail, in writing or by telephone about the expected delivery time, whereby the web shop must be given a maximum period of thirty (30) days in order to perform. In accordance with the legal conditions, the buyer has the right to cancel the agreement free of charge at the webshop. Any payments will in that case be refunded to the buyer as soon as possible, but within a maximum of 30 days after notification.

5.3. The webshop sends the products with Different Postal Services.

5.4. The webshop only ships products within the Netherlands, Belgium and Luxembourg. Other countries in consultation.

Article 6. Delivery and risk
The webshop is in no way liable for misunderstandings, damage, delays or unclear transmission of orders and communications as a result of the Internet or any other means of communication in the traffic between the webshop and buyer. The colors of the products shown on the webshop may differ from the real colors of the product. The webshop takes the risk of shipping entirely.

Article 7. Shipping costs
All orders are delivered to an address to be specified by the buyer. A fixed rate including VAT applies.

Article 8. Deliveries and guarantees
8.1. The webshop guarantees that every product delivered by it meets the normal requirements of reliability and usability.

There can be no guarantee if the wear can be considered normal and further in the following cases:

• if changes have been made to the product, including repairs that have not been carried out with the permission of the webshop;
• if the original purchase invoice cannot be submitted, has been changed or made illegible;
• if damage is caused by intent, gross negligence or negligent maintenance.

Article 9. Exchange / return
9.1. If the buyer is of the opinion that the delivery does not comply with the agreement, the buyer has the option of replacing this delivery with a new delivery, within fourteen (14) days after delivery of the order.

9.2. The buyer must register this return shipment in advance with the webshop.
The item must be returned to the webshop in its original packaging and in its original condition with a copy of the purchase invoice. As soon as the product is received in good condition with a copy of the purchase invoice from the webshop, the purchase amount of the product is transferred to an account number specified by the buyer.

9.3. The shipping costs for returning the product are for the account of the buyer.

Article 10. Defective incomplete shipments
The risk of loss or damage to items that are the subject of the agreement is transferred to the buyer at the moment the goods are offered for receipt at the specified address and taken into receipt. In the event of a defect being found, the buyer must immediately report this to the webshop after receiving the products. The costs of return shipments in case of default are for the account of the webshop.

Article 11. Retention of title
The ownership of the products and / or services supplied will only be transferred to the buyer if the buyer has paid everything he owes to the webshop on the basis of any agreement. The risk with regard to the products is transferred to the buyer at the time of delivery.

Article 12. Force majeure
12.1. Without prejudice to the other rights vested in the web shop, in the event of force majeure, the web shop has the right, at its option, to suspend the execution of the order, or to dissolve the agreement without judicial intervention, in writing by the buyer. parts and this without the webshop being obliged to pay any compensation, unless this would be unacceptable in the given circumstances by standards of reasonableness and fairness.

12.2. Force majeure is understood to mean any shortcoming that cannot be attributed to it, because it is not due to its fault and is not for its account under the law, legal act or generally accepted views. Force majeure is taken to mean that each of the web shops wants an independent circumstance that prevents the fulfillment of its obligations towards the buyer wholly or partially. These circumstances include strikes, fire, business disruptions, energy disruptions, disruptions in a (telecommunications) network or connection or used communication systems and / or the unavailability of the webshop at any time, non-delivery or late delivery by suppliers or other third parties involved and the absence of any government-issued license.

Article 13. Miscellaneous
13.1. If the buyer submits a written address to the web shop for an address, the web shop is entitled to send all orders to that address, unless the buyer writes to the web shop in writing from another address to which the order must be sent.

13.2. If the web shop allows deviations from these terms and conditions for a short or longer period of time, whether tacitly or not, this does not affect its right to demand immediate and strict compliance with these terms and conditions. The buyer can never assert any right based on the fact that the webshop flexibly applies these conditions.

13.3. If one or more of the provisions of these terms and conditions or any other agreement with the webshop should conflict with any applicable legal provision, the relevant provision will lapse and be replaced by a new legally permissible comparable determination.

13.4. The webshop will only process the buyer's data in accordance with its privacy policy which is included in its Privacy Statement which is also included on the webshop. The webshop takes into account the applicable laws and regulations.

Article 14. Applicable law and competent court
14.1 All rights, obligations, offers, orders and agreements to which these conditions apply, as well as these conditions, are exclusively governed by Dutch law.

14.2. All disputes between parties will be submitted exclusively to the competent court.
